Ethics Regulations of the Korean Society of Oral and Maxillofacial Pathology

Chapter 1. General Provisions

Article 1 (Purpose)
The purpose of these regulations is to establish research ethics, prevent research misconduct in advance, and stipulate the necessary matters for fair and systematic verification of truthfulness when research misconduct occurs.



Article 2 (Subject of Application)
These regulations apply to those who have participated directly or indirectly in, or are related to, research activities.



Article 3 (Definition of Terms)
① "Research misconduct" refers to forgery, falsification, plagiarism, and unjustified listing of paper authors, etc., committed in proposing research, conducting research, reporting and presenting research results, and the details are as follows:

1. Forgery: The act of creating fictitious data or research results that do not exist and recording or reporting them.

2. Falsification: The act of manipulating research-related materials, equipment, and processes, or changing or omitting data or research results so that research records do not match the truth.

3. Plagiarism: The act of stealing others' ideas, research processes, results, or records without appropriate citation.

4. Unjustified listing of paper authors: The act of not granting paper authorship without justifiable reasons to a person who has made a scientific or technical contribution to the research contents or results, or granting paper authorship to a person who has not made a scientific or technical contribution out of gratitude or courtesy.

5. Duplicate publication: The act of publishing the researcher's own research results twice or more in the same language or a different language without citation, or using the same research data and sentences as already published research results.

6. Acts that deviate from the range commonly accepted in the relevant academic field.

7. The act of proposing, forcing, or threatening another person to commit the above misconduct.

8. The act of intentionally interfering with the investigation of one's own or another's suspected misconduct or harming the informant.

9. Use and Limitations of Generative AI or AI-Assisted Technologies: Generative AI or AI-assisted technologies and services utilizing such technologies may be used only as auxiliary tools for improving readability and language expression. Their use for creating text, generating/editing/synthesizing tables or figures is restricted. However, exceptions could be made when such technologies are themselves the object of study or are used in the processes of data collection or analysis. In such cases, authors should describe this use in detail in the Methods section.

② "Informant" refers to a person who notifies the relevant research institute or research funding institute of the fact of recognizing misconduct or related evidence.
③ "Examinee" refers to a person who becomes the subject of an investigation for misconduct by a report or the recognition of the research institute, or a person who is assumed to have participated in misconduct during the investigation and becomes the subject of the investigation. However, reference witnesses or witnesses during the investigation process are not included.
④ "Preliminary investigation" refers to the procedure for determining whether it is necessary to officially investigate the suspicion of misconduct.
⑤ "Main investigation" refers to the procedure for proving whether the suspicion of misconduct is true.
⑥ "Judgment" refers to the procedure for confirming the investigation results.



Chapter 2. Establishment and Operation of the Research Ethics Committee

Article 4 (Research Ethics Committee)
To deliberate and investigate all matters concerning the research ethics of this society, a Research Ethics Committee (hereinafter referred to as the "Committee") shall be established.



Article 5 (Function)
The Committee deliberates on the following items:

1. Matters concerning the establishment and operation of systems related to research ethics.

2. Matters concerning the initiation of preliminary and main investigations and the results of the investigations.

3. Matters concerning the processing of research ethics verification results and follow-up measures.

4. Matters concerning the protection of informants and the restoration of honor of examinees.

5. Matters concerning various measures for preventing misconduct and inappropriate acts.

6. Other matters referred by the Chairperson.



Article 6 (Composition)
① The Committee shall be composed of up to 10 members who have no conflict of interest with the examinee.
② Members are recommended by the Director of General Affairs.
③ The Chairperson and Vice-Chairperson are elected from among the committee members.
④ A secretary shall be appointed by the Chairperson to handle the administrative affairs of the Committee.



Article 7 (Term of Office)
① The term of office for members is two years, and they may be reappointed.
② The term of office for a newly appointed member due to a vacancy shall be the remaining term of their predecessor.



Article 8 (Duties of the Chairperson)
① The Chairperson presides over the meetings of the Committee and represents the Committee.
② If the Chairperson is unable to perform their duties, the Vice-Chairperson shall act on their behalf.



Article 9 (Convocation of Meetings)
① The Committee shall be convened by the Chairperson when the Chairperson deems it necessary or when a majority of the incumbent members requests it.
② Meetings shall be closed in principle, but if deemed necessary, relevant persons may be summoned to attend and hear their opinions.



Article 10 (Quorum for Meetings and Resolutions)
The Committee shall open with the attendance of a majority of the incumbent members and resolve with the affirmative vote of two-thirds or more of the attending members.



Article 11 (Meeting Minutes)
The Committee must prepare meeting minutes, which must be signed and sealed by all attending members, including the Chairperson.



Article 12 (Reporting)
Matters deliberated by the Committee shall be reported to the President in accordance with the regulations on delegated decision-making.



Article 13 (Detailed Operating Rules)
Matters necessary for the operation of the Committee other than these regulations shall be determined by the Chairperson through a resolution of the Committee.



Chapter 3. Verification of Research Truthfulness

Article 14 (Reporting and Receipt of Misconduct)
As a rule, an informant should report the name of the research project, the title of the paper, specific details, and evidence related to the misconduct to the President or Editor-in-Chief in their real name using methods such as oral statement, in writing, by phone, or via e-mail.



Article 15 (Period and Method of Preliminary Investigation)
① The preliminary investigation must commence within 15 days from the date of receipt of the report and must be completed within 30 days from the start date of the investigation.
② The preliminary investigation must review the following items:

1. Whether the reported contents fall under the misconduct in Article 3, Paragraph 1.

2. Whether the reported contents have the specificity and clarity to necessitate and benefit from conducting a main investigation.

3. Whether 5 years have passed since the date of the report from the starting date of the statute of limitations.

③ The preliminary investigation may request opinions and statements from the informant, examinee, etc., if necessary.



Article 16 (Processing of Preliminary Investigation Results)
① If the main investigation is not to be conducted, the Research Ethics Committee must notify the informant and the examinee of the results of the preliminary investigation in writing according to Article 23, Paragraph 3.
② The preliminary investigation result report must include the following:

1. Specific contents of the report.

2. Suspicions of misconduct that were investigated and related research papers.

3. Whether to conduct a main investigation and the basis for the judgment.

4. If the main investigation is not conducted, the role of the examinee in the relevant research project, whether the suspicion is true, the contents of objections or defenses raised by the informant and examinee regarding the investigation results, and the results of their processing.

5. Other relevant evidence.

6. List of Research Ethics Committee members.



Article 17 (Initiation and Period of Main Investigation)
① The main investigation must commence within 30 days after the Research Ethics Committee approves the results of the preliminary investigation. However, if the examinee admits the suspected facts during the preliminary investigation, the main investigation procedure may be omitted.
② The main investigation, including the judgment, must be completed within 90 days from the start date of the investigation.
③ If it is determined that the investigation cannot be completed within the period specified in Paragraph 2, the period shall be extended.



Article 18 (Request for Attendance and Submission of Materials)
① The Committee may request the attendance of the informant, examinee, witnesses, and reference witnesses for statements, in which case the examinee must attend. However, if the examinee fails to comply despite two or more written requests for attendance, the investigation may proceed by stating that fact in the record.
② The Committee may request the examinee to submit materials, and to preserve evidence, it may restrict access to the laboratory for those involved in misconduct and confiscate and store the relevant research materials with the approval of the President.



Article 19 (Protection of Rights of Informants and Examinees and Strict Confidentiality)
① Under no circumstances should the informant's identity be exposed directly or indirectly, and the informant's name may not be included in the investigation result report to protect the informant unless absolutely necessary.
② If the informant suffers disadvantages in status such as disciplinary action, discrimination in working conditions, unfair pressure, or harm due to reporting misconduct, the damage must be restored to its original state, or measures required by the informant must be taken.
③ Care must be taken not to infringe upon the honor or rights of the examinee until the verification of the misconduct is completed, and efforts must be made to restore the honor of an examinee who is found not guilty.
④ All matters related to the investigation, including reporting, investigation, deliberation, resolution, and proposed measures, shall be kept confidential, and those directly or indirectly involved in the investigation and staff must not leak any information acquired during the investigation and performance of duties. However, if there is reasonable need for disclosure, it may be disclosed through a resolution by the Research Ethics Committee.



Article 20 (Exclusion and Challenge of Members)
① A member who has a direct conflict of interest with the agenda in question cannot participate in the preliminary and main investigations.
② If the examinee has considerable reason to believe there is a concern about an unfair investigation, they may clarify the fact in writing and apply for a challenge.
③ When there is an application for a challenge under Paragraph 2, the investigation committee shall decide whether to accept the challenge by resolution. In this case, the person challenged cannot participate in the investigation committee.



Article 21 (Guarantee of the Right to Raise Objections and Defend)
The Committee must equally guarantee the rights and opportunities for stating opinions, raising objections, and defending to the informant and the examinee, and must notify them of the related procedures in advance.



Article 22 (Judgment and Notification)
① The Committee determines the investigation contents and results based on the contents of the objections or defenses.
② If no agreement is reached on the investigation contents and results, it may be decided by a vote, in which case it requires the attendance of a majority of the incumbent members and the affirmative vote of two-thirds or more of the attending members.
③ The informant and examinee must be notified in writing within 10 days after obtaining the approval of the President of the Research Ethics Committee.



Article 23 (Submission of Main Investigation Result Report)
① The Committee must submit the main investigation result report (hereinafter referred to as the "final report") to the Board of Directors of this society within 10 days after the judgment.
② The final report must include the following:

1. Specific contents of the report and the identity information of the informant.

2. Suspicions of misconduct that were the subject of the investigation and related research projects.

3. The role of the examinee in the relevant research paper and whether the suspicion is true.

4. Relevant evidence and witnesses.

5. Contents of objections or defenses raised by the informant and examinee regarding the investigation results and the results of their processing.

6. List of Research Ethics Committee members.



Article 24 (Re-deliberation)
If the informant or examinee is dissatisfied with the decision of the Research Ethics Committee, they may request a re-deliberation in writing to the Research Ethics Committee within 15 days from the date of receiving the notice of the decision.



Chapter 4. Measures After Verification

Article 25 (Reporting to Research Funding Institutions, etc.)
① The final report shall be submitted to the head of the institution that supported the relevant research project or the head of the researcher's affiliated institution within 10 days after obtaining the approval of the President, and materials related to the investigation may be submitted if requested by a higher-level institution, etc..
② Notwithstanding the provisions of Paragraph 1, the following matters must be reported immediately to a higher-level institution even during the investigation process:

1. In case of violation of laws or relevant rules.

2. In case a serious danger to public welfare or safety occurs or is highly likely to occur.

3. In case action is required by the research funding institution or the researcher's affiliated institution.



Article 26 (Measures Regarding the Results)
① The Research Ethics Committee may recommend appropriate measures to the President, such as retracting the relevant paper, for those involved in misconduct.
② The President must take appropriate measures in accordance with the relevant regulations according to the recommendation of Paragraph 1 against the examinee.



Article 27 (Storage and Disclosure of Records)
① Records related to the preliminary and main investigations shall be kept by the society and preserved for 5 years after the end of the investigation.
② Information related to identity may be excluded from disclosure.



Addendum [March 1, 2026]
These regulations take effect from March 1, 2026.

제 1 장 총 칙

제1조(목적)
이 규정은 연구윤리를 확립하고 연구부정행위를 사전에 예방하며, 연구 부정행위 발생 시 공정하고 체계적인 진실성 검증을 위해 필요한 사항을 규정함을 목적으로 한다.



제2조(적용대상)
이 규정은 연구활동에 직·간접적으로 참여하였거나 관련이 있는 자를 그 대상으로 한다.



제3조(용어의 정의)
① 연구부정행위라 함은 연구의 제안, 연구의 수행, 연구결과의 보고 및 발표 등에서 행하여진 위조, 변조, 표절 및 부당한 논문저자의 표시행위 등을 말하며 그 내용은 다음 각 호와 같다.

위조 : 존재하지 않는 데이터나 연구결과를 허위로 만들고 이를 기록하거나 보고하는 행위

변조 : 연구와 관련된 재료, 장비 및 과정 등을 조작하거나 데이터 또는 연구결과를 변경하 거나 누락시켜 연구기록이 진실에 부합되지 않도록 하는 행위

표절 : 타인의 아이디어, 연구과정, 결과 또는 기록 등을 적절한 인용표시 없이 도용하는 행위

부당한 논문저자의 표시 : 연구내용 또는 결과에 대하여 과학적·기술적 기여를 한 사람에게 정당한 이유 없이 논문저자의 자격을 부여하지 않거나, 과학적·기술적 기여를 하지 않은 자 에 게 감사의 표시 또는 예우 등을 이유로 논문 저자의 자격을 부여하는 행위

이중게재 : 연구자 본인의 연구결과를 인용표시 없이 동일언어 또는 다른언어로 중복하여 출 간하거나 이미 출간된 연구결과와 동일한 연구데이터 및 문장을 사용하는 행위

기타 관련 학계에서 통상적으로 용인되는 범위를 벗어난 행위

타인에게 상기의 부정행위를 행할 것을 제안 또는 강요하거나 협박하는 행위

본인 또는 타인의 부정행위 혐의에 대한 조사를 고의로 방해하거나 제보자에게 위해를 가 하는 행위

생성형 AI 또는 이를 활용한 AI 보조 기술 및 서비스는 가독성 및 언어 표현의 개선을 위한 보조적 도구로만 사용할 수 있다. 텍스트 작성이나 표·그림의 생성·편집·합성 목적으로 사용하는 것은 제한된다. 다만, 해당 기술 자체가 연구 대상이거나 데이터 수집 또는 분석 과정에서 사용되는 경우에는 예외가 적용될 수 있으며, 이 경우 저자는 그 사용 내용을 방법(Methods) 섹션에 상세히 기술해야 한다.

② ‘제보자’라 함은 부정행위를 인지한 사실 또는 관련 증거를 해당 연구기관 또는 연구지원 기관에 알린 자를 말한다.
③ ‘피조사자’라 함은 제보 또는 연구기관의 인지에 의하여 부정행위의 조사대상이 된 자 또는 조사 수행과정에서 부정행위에 가담한 것으로 추정되어 조사의 대상이 된 자를 말한다. 다만, 조사과정에서의 참고인이나 증인은 이에 포함되지 아니한다.
④ ‘예비조사’라 함은 부정행위의 혐의에 대하여 공식적으로 조사할 필요가 있는지 여부를 결정하기 위한 절차를 말한다.
⑤ ‘본조사’라 함은 부정행위의 혐의에 대한 사실 여부를 입증하기 위한 절차를 말한다.
⑥ ‘판정’이라 함은 조사결과를 확정하는 절차를 말한다.



제 2 장 연구윤리위원회 설치 및 운영

제4조(연구윤리위원회)
본 학회의 연구윤리에 관한 제반사항을 심의·조사하기 위하여 연구윤리위 원회(이하 ‘위원회’라 한다)를 둔다.



제5조(기능)
위원회는 다음 각 호의 사항을 심의한다.

① 연구윤리 관련 제도의 수립 및 운영에 관한 사항

② 예비조사, 본조사의 착수 및 조사결과에 관한 사항

③ 연구윤리 검증 결과의 처리 및 후속조치에 관한 사항

④ 제보자 보호 및 피조사자 명예회복 조치에 관한 사항

⑤ 부정행위 및 부적절행위의 예방을 위한 각종 조치에 관한 사항

⑥ 기타 위원장이 부의하는 사항



제6조(구성)
① 위원회는 피조사자와 이해관계가 없는 10인 이내로 구성한다.
② 위원은 총무이사가 추천한다.
③ 위원장과 부위원장은 위원회에서 호선한다.
④ 위원회의 사무처리를 위하여 간사를 두며 위원장이 임명한다.



제7조(임기)
① 위원의 임기는 2년으로 하되, 연임할 수 있다.
② 결원으로 인하여 새로이 위촉되는 위원의 임기는 전임자의 잔임기간으로 한다.



제8조(위원장의 직무)
① 위원장은 위원회의 회의를 주재하고, 위원회를 대표한다.
② 위원장이 사고가 있을 경우에는 부위원장이 그 직무를 대행한다.



제9조(회의소집)
ⓛ 위원회는 위원장이 필요하다고 인정할 때 또는 재적위원 과반수의 요구가 있을 때 위원장이 소집한다.
② 회의는 비공개를 원칙으로 하되, 필요하다고 인정될 때에는 관계인을 출석시켜 의견을 청취할 수 있다.



제10조(의사 및 의결정족수)
위원회는 재적위원 과반수의 출석으로 개회하고, 출석위원 3분의 2 이 상의 찬성으로 의결한다.



제11조(회의록)
위원회는 회의록을 작성하여야 하고, 회의록에는 위원장을 포함하여 출석위원 전원이 서명·날인한다.



제12조(보고)
위원회에서 심의한 사항은 위임전결규정에 의하여 회장에게 보고한다.



제13조(운영세칙)
이 규정 외에 위원회의 운영에 관하여 필요한 사항은 위원회 의결을 거쳐 위원장 이 정한다.



제 3 장 연구진실성검증

제14조(부정행위 제보 및 접수)
제보자는 부정행위와 관련된 연구과제명, 논문명 및 구체적인 내용 과 증거를 구술, 서면, 전화 또는 전자우편 등의 방법으로 회장 또는 편집장에게 실명으로 제보함을 원칙으로 한다.



제15조(예비조사의 기간 및 방법)
① 예비조사는 신고 접수일로부터 15일 이내에 착수하고, 조사 시작일로 부터 30일 이내에 완료하여야 한다.
② 예비조사는 다음 각 호의 사항을 검토하여야 한다.

제보내용이 제3조 제1항의 부정행위에 해당하는지 여부

제보내용이 구체성과 명확성을 갖추어 본 조사를 실시할 필요성과 실익이 있는지 여부

제보일이 시효 기산일로부터 5년을 경과하였는지 여부

③ 예비조사는 필요할 경우 제보자, 피조사자 등에 대한 의견 및 진술을 요구할 수 있다.



제16조(예비조사 결과의 처리)
① 연구윤리위원회는 본 조사를 실시하지 않을 경우 예비조사의 결과에 대하여 제23조 제3항에 의거 제보자와 피조사자에게 문서로써 통보하여야 한다.
② 예비조사의 결과보고서에는 다음 각 호의 내용이 포함되어야 한다.

제17조(본조사 착수 및 기간)
① 본 조사는 연구윤리위원회의 예비조사 결과 승인 후 30일 이내에 착수하여야 하며 다만, 예비조사에서 피조사자가 혐의사실을 인정한 경우에는 본 조사 절차를 생략할 수 있다.
② 본 조사는 판정을 포함하여 조사 시작일로부터 90일 이내에 완료하여야 한다.
③ 제2항의 기간 내에 조사를 완료할 수 없다고 판단될 경우 기간을 연장한다.



제18조(출석 및 자료제출 요구)
① 위원회는 제보자, 피조사자, 증인 및 참고인에 대하여 진술을 위 한 출석을 요구할 수 있으며, 이 경우 피조사자는 반드시 출석하여야 한다. 다만, 피조사자에게 2회 이상 서면으로 출석을 요구하였음에도 불구하고, 불응할 때에는 그 사실을 기록에 명시하 고 조사를 진행할 수 있다.
② 위원회는 피조사자에게 자료의 제출을 요구할 수 있으며, 증거자료의 보전을 위하여 총장의 승인을 얻어 부정행위 관련자에 대한 실험실 출입제한 및 해당 연구자료의 압수·보관 등을 할 수 있다.



제19조(제보자와 피조사자의 권리보호 및 비밀엄수)
① 어떠한 경우에도 제보자의 신원을 직·간접적으로 노출시켜서는 아니되며, 제보자의 성명은 반드시 필요한 경우가 아니면 제보자 보호 차원에서 조사결과보고서에 포함하지 아니할 수 있다.
② 제보자가 부정행위 제보를 이유로 징계 등 신분상의 불이익, 근무조건상의 차별, 부당한 압력 또는 위해 등을 받은 경우 피해를 원상회복하거나 제보자가 필요로 하는 조치 등을 취하여 야 한다.
③ 부정행위에 대한 검증이 완료될 때까지 피조사자의 명예나 권리가 침해되지 않도록 주의하 여야 하며, 무혐의로 판명된 피조사자의 명예회복을 위해 노력하여야 한다.
④ 제보, 조사, 심의, 의결 및 건의조치 등 조사와 관련된 일체의 사항은 비밀로 하며, 조사에 직·간접으로 참여한 자 및 직원은 조사 및 직무수행 과정에서 취득한 모든 정보에 대하여 누설 하여서는 아니 된다. 다만, 합당한 공개의 필요성이 있는 경우 연구윤리위원회의 의결을 거쳐 공개할 수 있다.



제20조(위원의 제척, 기피 등)
① 위원이 당해 안건과 직접적인 이해관계가 있을 때에는 예비조사 및 본 조사에 참여하지 못한다.
② 피조사자는 불공정한 조사를 할 우려가 있다고 인정할 만큼 상당한 이유가 있을 때에는 그 사실을 서면으로 소명하고, 기피를 신청할 수 있다.
③ 제2항의 규정에 의한 기피신청이 있을 때에는 조사위원회의 의결로 기피 여부를 결정하여야 한다. 이 경우 기피신청을 받은 자는 조사위원회에 참여하지 못한다.



제21조(이의제기 및 변론의 권리 보장)
위원회는 제보자와 피조사자에게 의견진술, 이의제기 및 변 론의 권리와 기회를 동등하게 보장하여야 하며 관련절차를 사전에 통보하여야 한다.



제22조(판정 및 통보)
① 위원회는 이의제기 또는 변론의 내용을 토대로 조사내용 및 결과를 확정 한다.
② 조사내용 및 결과에 대한 합의가 이루어지지 않을 경우 표결로 결정할 수 있으며, 이 경우 재적위원 과반수이상의 출석과 출석위원 3분의 2 이상의 찬성으로 의결한다.
③ 연구윤리위원회 회장의 승인을 득한 후 10일 이내에 제보자와 피조사자 등에게 문서로써 통 보하여야 한다.



제23조(본조사 결과보고서의 제출)
① 위원회는 판정 후 10일 이내에 본 조사 결과보고서(이하“최종보고서”라 한다)를 본 학회의 이사회에 제출하여야 한다.
② 최종보고서에는 다음 각 호의 사항이 포함되어야 한다.

제24조(재심의)
제보자 또는 피조사자는 연구윤리위원회의 결정에 불복이 있을 경우 결정 통지를 받은 날로부터 15일 이내에 연구윤리위원회에 서면으로 재심의를 요청할 수 있다.



제 4 장 검증 이후의 조치

제25조(연구지원기관등에 대한 보고)
① 최종보고서는 회장의 승인을 받은 후 10일 이내에 해당 연 구과제를 지원한 기관 또는 해당 연구자의 소속기관장에게 제출하며, 상급기관 등에서 요청이 있을 경우 조사와 관련된 자료를 제출할 수 있다.
② 제1항의 규정에도 불구하고 다음 각 호의 사항에 대해서는 조사과정 중이라도 즉시 상급기관에 보고하여야 한다.

법령 또는 해당 규칙을 위반한 경우

공공의 복지 또는 안전에 중대한 위험이 발생하거나 발생할 우려가 명백한 경우

연구지원기관 또는 연구자의 소속기관에 조치가 필요한 경우



제26조(결과에 대한 조치)
① 부정행위 관련자에 대해 연구윤리위원회는 해당 논문의 철회 등 회장에게 적절한 조치를 건의할 수 있다.
② 회장은 피조사자에 대하여 제1항의 건의에 따라 관련 규정에 의하여 적절한 조치를 하여야 한다.



제27조(기록의 보관 및 공개)
① 예비조사 및 본조사와 관련된 기록은 학회에서 보관하며, 조사 종료 이후 5년간 이를 보존하여야 한다.
